It was 11:30 p.m. Oct 25. A joint birthday party for James (Sonny) Phillips and his wife, Leola, was "in high gear at 717 E. 131st St. There had been an argument at the party earlier.

Police said most of the partygoers were involved. But now, the party was alive, the music blared and drinks flowed freely. Suddenly, the front door swung open. A man who had been at the party. during the argument stepped inside.

A witness heard the man shout, "Yeah, damn it. Y'all are still here." The man, leveled a carbine and opened fire. He emptied one cartridge clip, reloaded and started firing again. and Five persons fell dead, including Phillips his wife. Three others were wounded.

Eight persons, including two teen-age boys and a pregnant teen-age girl, were gunned down in a 24-hour period just five days earlier. The killings are grisly testimony to the cold fact that there were more than 320 homicides in Cleveland in 1974. It. was only the second year in Cleveland's history in which homicides exceeded 300, police said. The record is 333, set in 1972.

There were 357 homicides in Cuyahoga County, according to Dr. Lester Adelson, deputy coroner. The county record is 363, also set in 1972. "The depressing thing is that we can sit and discuss these killings objectively." Dr. Adelson said yesterday.

"We have lost the 'capacity to become 1. outraged by them." The slaughter, however. did outrage much of the Cleveland community. Public officials and citizens demanded action. In October, the bloodies month of the year with 38 killings, City, Council President George L.

EL Forbes, D-20, he would push for legislation to permit "modified search a and seizure" by police. No such legislation has been introduced to date. It is the handgun that has caused the most death and destruction in Cleveland streets, police said: of all homicides were committed with handguns. Adelson said that of the 1,500 atopsies he fr performed in 1974, the first and last were homicides. The first recorded homicide of the year was Martin Vasicek, 78. of 11125 Parkview Ave. SE. whose body was foudn in the garage of property he maintained at 2968 East Blvd.

She died seven hours later. 4 During the trial of the men accused in the shooting of Kimberly, there was testimony that the gun went off accidentally. Two groups of youths had in a running feud in the area. Two men were convicted of murder in the little girl's death. A third was acquitted.

"The most disturbing Dr. Adelson said, "is the predictability. We know that in the next 365 days more than 300 persons will be killed in this civilized community. "And this does not even begin to count those who don't die. How about those who are left crippled nor left scarred of body or soul? Year -end statistics on homicides are like the tip A of an iceberg of the human violence in our community," he' said.
